Terms and Conditions of Sale

These Terms and Conditions apply to consumers purchasing goods from Furness Tiles and Flooring. Nothing in these Terms affects your statutory rights under UK consumer law.

1. Definitions

1.1 Company means Furness Tiles and Flooring.

1.2 Buyer means a consumer purchasing goods for personal use.

1.3 Goods means products supplied by the Company.

1.4 Contract means the agreement for the sale of Goods between the Company and the Buyer.

1.5 Price means the price of the Goods inclusive of VAT and exclusive of delivery charges.

1.6 Writing includes email and other electronic communication.

2. Basis of Sale

2.1 All orders are subject to acceptance by the Company.

2.2 These Terms apply to all consumer sales and supersede any previous agreements.

2.3 It is the Buyer’s responsibility to ensure order details and quantities are correct before placing an order.

2.4 Any guidance provided on quantities is indicative only and the Buyer remains responsible for ordering sufficient quantities.

3. Prices and Payment

3.1 Prices are inclusive of VAT and exclusive of delivery charges.

3.2 Full payment must be received before dispatch of Goods.

3.3 Ownership of the Goods does not pass to the Buyer until full payment has been received.

4. Product Information

4.1 Product descriptions, images and samples are provided for guidance only.

4.2 Natural products may vary in colour, texture, size and finish. Such variations are not considered faults.

4.3 Buyers should order sufficient quantities to allow for wastage, cuts and natural variation.

5. Delivery

5.1 Delivery charges are calculated at checkout.

5.2 Delivery dates are estimates only.

5.3 Goods are delivered to the nearest accessible point, which may be kerbside.

5.4 Risk passes to the Buyer upon delivery.

6. Examination of Goods

6.1 Buyers should inspect Goods as soon as reasonably possible after delivery.

6.2 Reporting damage at delivery assists us in resolving issues but does not affect your statutory rights.

7. Your Right to Cancel (Change of Mind)

7.1 You have the right to cancel your Contract within 14 calendar days of receiving the Goods.

7.2 To cancel, you must notify the Company in Writing within the 14-day cancellation period.

7.3 Returned Goods must be unused, in original packaging and in a resaleable condition.

7.4 You are responsible for return delivery costs when cancelling due to a change of mind.

7.5 Refunds will be processed within 14 days of receiving the returned Goods or proof of return.

8. Faulty, Damaged or Incorrect Goods

8.1 Goods must be of satisfactory quality, fit for purpose and as described.

8.2 If Goods are faulty, damaged or incorrect, you are entitled to a repair, replacement or refund in accordance with the Consumer Rights Act 2015.

8.3 Where Goods are faulty, the Company will cover reasonable return delivery costs.

8.4 You have the right to reject faulty Goods within 30 days of delivery for a full refund.

9. Exclusions

9.1 Bespoke or made-to-order Goods may be excluded from cancellation rights unless faulty.

9.2 Ex-display Goods are sold as seen but this does not affect your rights where Goods are faulty or misdescribed.

10. Liability

10.1 Nothing in these Terms limits or excludes liability for death or personal injury caused by negligence, fraud, or any matter that cannot be excluded by law.

10.2 Subject to the above, the Company’s liability is limited to the Price paid for the Goods.

11. General

11.1 If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions remain in full force.

11.2 These Terms are governed by the laws of England and Wales and disputes shall be subject to the jurisdiction of the English courts.
